CPCB issues guidelines for Control of Pollution and Enforcement of Environment norms

The Central Pollution Control Board (CPCB) on September 21, 2020 has issued Mechanism or Guidelines for Control of Pollution and Enforcement of Environment norms at individual Establishments and Area, Cluster of Restaurants, Hotels, Motels, Banquets, etc. CPCB in compliance with the Hon’ble NGT’s order dated September 19, 2020, in the matter of Westend Green Farms Society V. Union of Indian & Ors. has prepared the guidelines. Hon’ble NGT considering the adverse impact on the environment and public health due to violation of environment norms has asked CPCB to lay down guidelines for the individual entities with coercive measures in case of violation and also a monitoring mechanism.

The following guidelines are issued:-

• Individual units have to provide necessary facilities for control of air, water & noise pollution, solid waste management, etc.

• Individual units have to take necessary approvals from the concerned authorities to establish or operate under the Air/Water Act, Fire Safety Certificate/NOC, etc.

• Local Authorities have to ensure the provision of adequate common facilities for water pollution, parking, solid waste management, etc.

• The State Board shall have a monitoring mechanism to evaluate compliance with the norms of individual units at least twice a year. As per NGT Directions, such report shall be submitted to CPCB.
