Draft Himachal Pradesh Motor Vehicle (Second Amendment) Rules, 2020

The Department of Transport of Himachal Pradesh on September 04, 2020 has issued the Himachal Pradesh Motor Vehicles (Second Amendment) Rules, 2020 to further amend the Himachal Pradesh Motor Vehicles Rules, 1999. 

The following amendments have been made: 

• Rule 69 (B)(2)(b) which specifies the retention of the registered mark on the vehicle by the owner or bidder for a stipulated period, if the vehicle has been disposed off has been inserted, namely: 

“In case a particular registration mark (SRM) belongs to an individual or organization (SRM obtained through e-auction) owned vehicle which is disposed of the said registration mark shall be retained only by the bidder for period as mentioned in sub-rule otherwise the same shall be available with the Registration Authority for re-allotment and new registration mark shall be allotted as per procedure mentioned in clause (iii),”

• Rule 69 (B)(3), which specifies the reassignment of special registration mark to vehicles that are registered within the state, has been inserted, namely: 

“The vehicle of the owner on which Himachal Pradesh registration mark has been allotted shall be entitled to get the said mark replaced by SRM as provided in Rule 69-B(a) obtained through e-auction/bidding process provided that:

1. The vehicle is not subject to an agreement of hire purchase/lease/ hypothecation.

2. The vehicle is not involved in any criminal proceedings as certified by NCRB/SCRB report.

3. The vehicle is subject to clearance of all dues and Taxes. 

4. The owner of the vehicle can avail this facility once in the entire life of the vehicle.

5. The existing number against which the new number has been obtained through e-auction/bidding process can be retained by the owner for the period as mentioned in sub-rule 2 and get it affixed on new vehicle owned by him or frozen by the R&LA concern.”

If any person, likely to be affected by these draft rules, has any objections(s) or suggestions(s) to make with regard to these draft rules, he may send the written objection(s) or suggestion(s) to the Principal Secretary (Transport) to the Government of Himachal Pradesh, Shimla-2 within a period of 7 days from the date of publication of the said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh. The objection(s) or suggestion(s), if any, received within the above stipulated period, shall be taken into consideration by the Government of Himachal Pradesh before finalizing the said draft rules.
